General Terms And Conditions

Applicability

All deliveries from Creaderm GmbH & Co. KG (hereinafter "seller") to consumers or entrepreneurs (hereinafter "customer") are subject to these General Terms and Conditions (GTC). The inclusion of the customer's own terms and conditions is hereby objected to, unless otherwise agreed.
A consumer is any natural person who enters into a legal transaction for a purpose that can predominantly be attributed neither to his commercial nor to his independent professional activity.
An entrepreneur within the meaning of these GTC is any natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his or her independent professional or commercial activity.

The purchase contract is concluded with Creaderm GmbH & Co. KG, Turnerstr. 54b, 33602 Bielefeld, Germany, Commercial Register: Bielefeld Local Court, HRA 17148.

The presentation of the products in the online shop does not constitute a legally binding offer, but only an invitation to order.
By completing the ordering process, you place a binding order for the goods listed on the order page. Your purchase contract is concluded when we accept your order by sending an order confirmation by e-mail immediately after receiving your order.
Order processing and contact usually take place via e-mail and automated order processing. The customers must ensure that the e-mail addresses provided by them for order processing are correct so that e-mails sent by the seller can be received at their addresses. In particular, when using SPAM filters, the customer must ensure that all e-mails sent by the seller or by third parties commissioned by the seller to process the order can be delivered.

If you are a consumer (i.e. a natural person who places the order for a purpose that cannot be attributed to your commercial or independent professional activity), you have a right of withdrawal in accordance with the statutory provisions.
If you, as a consumer, make use of your right of withdrawal, you must bear the regular costs of the return shipment.
In all other respects, the provisions set out in detail in the following cancellation policy shall apply to the right of withdrawal.

The prices stated on the product pages include statutory VAT and other price components, unless otherwise stated.
In addition to the stated prices, we charge shipping costs for the delivery. The shipping costs will be displayed during the ordering process.
In the case of deliveries to countries outside the European Union, further costs may be incurred in individual cases for which the seller is not responsible, and which are to be borne by the customer. These include, for example, costs for the transfer of money by credit institutions (e.g. transfer fees, exchange rate fees) or import duties or taxes (e.g. customs duties).

The delivery of goods is regularly carried out by a transport company and to the delivery address specified by the customer. When processing the transaction, the delivery address specified in the seller's purchase transaction shall be decisive. Deviating from this, if the payment method PayPal is selected, the delivery address deposited by the customer with PayPal at the time of payment shall be used.
If the transport company returns the dispatched goods to the seller because delivery to the customer was not possible, the customer shall bear the costs for the unsuccessful dispatch. This does not apply if they are not responsible for the circumstance that led to the impossibility of delivery or if they were temporarily prevented from accepting the service offered, unless the seller had given reasonable advance notice of the service.

Various payment options are available to the customer, which are indicated in the seller's online shop.
If payment in advance has been agreed, payment shall be due immediately after conclusion of the contract.

All legal relations between the parties shall be governed by the laws of the Federal Republic of Germany under exclusion of the laws on the international sale of movable goods. In the case of consumers, this choice of law shall only apply insofar as the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has their residence.
If the customer is a merchant, a legal entity under public law or a special fund under public law with its registered office in the territory of the Federal Republic of Germany, the exclusive place of jurisdiction for all disputes arising from this contract shall be the seller's registered office. If the customer has its registered office outside the territory of the Federal Republic of Germany, the seller's registered office shall be the exclusive place of jurisdiction for all disputes arising from this contract if the contract or claims arising from the contract can be attributed to the customer's professional or commercial activity. In the above cases, however, the seller shall in any case be entitled to bring an action before the court at the customer's place of business.
